Briefing Presentation
on Situation of Human Rights Defenders
(Khmer Kampuchea Krom People)


In Vietnam:

- Indigenous Khmer Krom are being violated their rights and persecuted and arrested because of demanding and protecting the freedom of religion, belief, assembly, expression, rights to culture, tradition and language, etc.
- Media and electronic internet and email are under controlled strongly.
- Freedom of expression are firmly restricted and arrested human rights defenders and journalists
- Their land are still confiscated and grabbed
- Grass-root leaders, human rights, journalists are arrested and detailed
- Lack of rights to access health care, social services
- Discrimination against them such as do not distribution (social welfare- no Khmer school, not encourage them to learn high, not allow KK to hold high position in the government), race.



In Cambodia:

- Khmer Kampuchea Krom (KKK) flee to stay in Cambodia they are under threatened and they have no security and safety because of the heads of Buddhist pagoda monks and local authorities did not allow and recognize them to stay in their pagodas and communities.
- Every demonstration conducted by Khmer Krom was severely dispersed and crackdowned by Cambodian authorities.
- KK nationality is not clear when they live in VN they are considered as Khmer and when they come to live in Cambodia known as native land. They are now becoming the stateless people.
- They are discriminated to issue the Cambodian ID card by some authorities.
- The Cambodian government uses the court as a tool to crackdown and put pressure on Khmer Krom defenders and other HRDs in Cambodia.
- Media people are shot to death, arrested and detained.
- Land eviction, dispute and grabbing of minority and indigenous people.
- Not clear mechanism on protecting the human rights defenders in Cambodia
- Government ratified CEDAW but government did not pay attention to apply the recommendation from the UN.
- Lack of women voice in the government structure
- National council on women is not worked well.
- National strategy on gender is important mechanism but not paid attention by government.
- National human rights commission (institution) is not yet formed.
- Killing of trade union workers, journalists, community leaders, and human rights defenders such as a KKK Buddhist monk was killed mysteriously in his pagoda in Kandal province following he attended the demonstration in front of Vietnam embassy in Phnom Penh few hours. All cases of killing on HRDs were dropped and not taken action by court.
- Corruption in the judicial system and government institutions is still existed.
- Forced eviction of community people in exchange for grabbing the lands by powerful and businessmen (Phnom Penh and provinces).
- Lack of law enforcement practice among competent authorities.
- Court is not independent and neutral under influence of ruling party-Cambodian People Party (CPP).



In Thailand:

When they have fled to live in Thailand they are facing serious problems followings:

- Unsafely and insecurity (Thai polices try to arrest them because they are undocumented and not yet recognized by UNHCR in Bangkok.
- UNHCR not yet clearly understands and know Khmer Krom who they are? Where they come from?
- They are now becoming the illegal migrants in Thailand
- They don’t have job, they have nothing to eat and poverty, additionally the Thai police come to seek to arrest them everyday.
- They don’t have health care, cannot access health
- Most of migrant workers are undocumented and illegal.They cannot return homeland because they will be arrested or killed by government officials and unknown persons.
